Interim government of Ukraine is illegal

The Yatsenyuk Government, formed on February 23, 2014, is unconstitutional.

According to Article 111 of Constitution of Ukraine (both of 2004 and 2010) the decision on the removal of the President of Ukraine from the office in compliance with the procedure of impeachment must be adopted by the Parliament (Verkhovna Rada) of Ukraine by at least three-quarters of its constitutional membership upon a review of the case by the Constitutional Court.

Article 76 of the Constitution provides that Verkhovna Rada comprises 450 people’s deputies. Therefore 337.5 (450*3/4) votes were required for impeachment of the President.

The decision on impeachment of Yanukovich was adopted by 328 votes, thus making the procedure illegitimate.

There were also lesser violations of impeachment, including non-establishing of a special ad hoc investigating commission and non-reviewal of the case by the the Constitutional Court.

Therefore Ukraine suffered coup d'etat.

The next conclusion is that the United States and Germany violated international law by recognizing Yatseniuk government.

Those who came to power in Ukraine not only threw rocks and Molotov's cocktails, but also used firearms against the police. The fact that these people are now supported by the West, diminishes trust with the bloc.
